中国国内可以用个人或法人申请；自然人注册需提交个人身份证或护照复印件，法人则需要营业执照副本复印件。

任何人都可随时使用香港政府知识产权署的免费搜索网页。搜索是否有相同或相似的注册香港商标和在先申请。
 
如果要委托本公司全面地和专业地搜索，则每搜索1商标在1个国际分类的收费是人民币500元。 所需时间是1个工作日。搜索报告是以书面作出, 内容包括确实在香港有无相同的注册商标和在先申请, 列出所搜索出的近似的商标, 并提供对近似商标是否构成，混淆相似，作出本所的专业书面意见。
 
如果客户所要申请的商标有文字也有图案，本公司的搜索将无加费地包括那文字和图案两部份。若是本公司书面意见作出正面的申请建议，而申请后出现审批员因有混淆相似的商标存在而作出的反对, 本公司将退还所有的申请收费。
 
商标注册处在审查有关申请前，会先详细检视申请表格及所有附件，以查看表格内须填写的部分是否已经填妥、有关资料是否正确、所需资料是否不全。如一切妥当，申请程序会进入下一阶段（实质审查阶段）。

 

香港商标注册实质审查

完成检查申请的不足之处并确定所有资料备妥后，商标注册处会翻查商标记录，以确定在相同或类似的货品或服务，是否有其他商户已经注册或申请注册相同或类似的商标。商标注册处会同时查核有关商标是否符合《商标条例》所订的注册规定。

登宪公告

商标注册处核准申请后，便会在香港知识产权公报公告，为期三个月，如无人提出异议，该商标就可以成功注册了。

 

注册

商标注册申请被核准后，便会把该商标的详细资料记入注册纪录册，并向申请人发出注册证明书。此外，商标注册处处长会在香港知识产权公报中公布有关的注册公告。注册日期会追溯至提交申请当日，换言之，作为注册商标拥有人的权利，应由提交申请当日起计。

 

申请商标费用

申请商标的收费为第一个国际分类为￥2380。 每加入一个分类需另外加收￥1800。付予香港政府的申请费以及查册费都已包括在内，公告、注册和领证都无另收费。除非申请受到审批员的反对，需要作出修改，遭受异议或者出现其它复杂情况，否则无其它的收费。

注册香港商标的保护措施

注册香港商标的有效期为7年，之后可续期14年，续展次数不限，香港商标注册有效期以申请日开始计算。在A部或在B部注册的商标法律地位有所不同。在A部注册的商标专用权有较大保障。A部的注册商标注册期满7年或视为永久有效；在 B部注册的商标则不享有相同的法律保障，在注册期满后，其注册效力仍可能受到质疑。在遇到商标侵权时，法院易于作出对A部注册商标侵权的认定，而对B部注册的商标所有人的指控，被告人可有较多的辩护理由，法院也可能不予颁发禁止令。

 

商标设计要注意以下问题

独创性，即商标的设计要有新意;商标的名称应避免与商品的功能联在一起;商标的设计要突出主题，合理布局。

侵权诉讼
